BI. FATOU BENSOUDA AANZA KAZI ICC.

Mwendesha mashtaka Mkuu mpya wa mahakama ya Kimataifa ya makosa ya jinai ICC, Fatou Bensouda anaanza kazi rasmi tarehe 15.06.2012. Lakini ni changamoto zipi zilizopo mbele ya mwanamama huyo kutoka Gambia?
"Mara nyingi unafanya kazi katika hali ya muendelezo wa migogoro, na hali ya usalama wakati mwingine inafanya utekelezaji wa majukumu usiwezekane bila kuhatarisha usalama wa mashahidi," Bensouda aliliambia shirika la habari la Ujerumani, dpa katika mahojiano maalumu, na kuongeza kuwa katika mazingira kama hayo, kazi inakuwa na changamoto kubwa.
Fatou alikuwa naibu mwendesha mashtaka wa mahakama ya ICC tangu mwaka 2004 na pia aliwahi kuwa Mwanasheria mkuu na mshauri wa rais katika nchi yake ya Gambia. Fatou alisema changamoto kubwa inayomkabili ni kukosa ushirikiano kutoka kwa baadhi ya mataifa yaliyosaini mkataba wa uanzishwaji wa mahakama hiyo.

Hatuna Jeshi wala Polisi
Alisema Mahakama ya ICC haina jeshi na wala haina polisi lakini polisi na majeshi ya mataifa 120 wanachama ndiyo polisi wa ICC na hivyo wana wajibu wa kusaidiana na mahakama hiyo katika kuwakamata watu kama kiongozi wa kundi la waasi la LRA Joseph Kony, rais wa Sudan Omar Hassan el Bashir, lakini akasema kuwa inasikitisha kuona watu hao bado hawajafikishwa mbele ya sheria.
Alivyoulizwa endapo mahakama ya ICC inavuruga utulivu wa kisiasa katika nchi kutokana na uchunguzi wa makosa ya jinai, Bensouda alisema kinyume chake, uchunguzi huo kwa mfano nchini Uganda, umechangia kwa kiwngo kikubwa kurejesha amani kaskazini mwa nchi hiyo licha ya ukweli kwamba hawajaweza kumkata Joseph Kony.
Alisema pia katika nchi ya Cote d' Vior, mahakama ya ICC pia imetoa mchango mkubwa. Tangu mwanzo tulisema tutafanya uchunguzi na tunangali pande zote zilizokuwa katika mgogoro huu. Kesi ya Laurent Gbagbo ndiyo ya kwanza....bila shaka kutakuwa na wengine, alisema.

Bensouda alisema changamoto nyingine inayoikabili mahakama hiyo ni juu ya shtuma zinazotolewa kwake kuwa inatumiwa na baadhi ya mataifa kuyaadhibu mataifa mengine huku pia ikilaumiwa kwa kesi ambazo zimeshindwa kufikishwa mbele yake, akitolea mfano wa Syria, ambayo hata hivyo alisema haikuridhia Mkataba wa Rome uliyoanzisha mahakama hiyo na hivyo si mwanachama wa ICC.
Alisema mahakama hiyo inaweza tu kuingilia kati nchini Syria kama Umoja wa mataifa utaitaka ifanye hivyo. hata hivyo, alisema kuanza mchakato wa kufungua mashtaka unaweza kuchukua muda mrefu kwa vile unahitaji uchunguzi wa hali juu kuweza kuja na ushahidi wa kutosha kuwafungulia mashataka wahusika, tofauti na inavyoonekana hivi sasa.

Bensouda alisema licha ya tuhuma kwamba mahakama ya ICC inawalenga waafrika pekee, kuwepo kwake katika nafasi ya mwendesha mashataka mkuu hakutaleta tofauti yoyote na kwamba ataendelea kuonyesha kuwa ICC inafanya kazi kwa ajili ya, na pamoja na waathirika wa Afrika, kwa sababu waathirika wote katika migogoro inayofikishwa mbele ya mahakama hiyo ni waafrika.
Bensouda anamrithi Luis Moreno Ocampo aliejipatia umaarufu kutokana na kuendesha kesi kadhaa zenye msisimko mkubwa ikiwa ni pamoja na rais wa zamani wa Liberia Charles Taylor, aliyehukumiwa hivi karibuni kwenda jela kwa miaka 50, na kudiriki kumuombea kibali cha kukamatwa, rais wa Sudan Omar el Bashir, ambaye hata hivyo Umoja wa Afrika unapinga kukamatwa kwake.
Ocampo alikuwa akishtumiwa kwa kutumia ubabe katika kipindi cha uongozi wake na inadaiwa wafanyakazi wengi wa juu wa idara yake walilaazimika kuacha kazi. Lakini Besnouda, ambaye hakukanusha tuhuma hizo dhidi ya bosi wake wa zamani alisema jambo la muhimu sasa ni kuendeleza mafanikio yaliyopatikana.
 
(CBS/AP) WASHINGTON - Effective immediately, the Obama administration will stop deporting and begin granting work permits to younger illegal immigrants who came to the U.S. as children and have since led law-abiding lives. The election-year initiative addresses a top priority of an influential Latino electorate that has been vocal in its opposition to administration deportation policies.
The policy change will affect as many as 800,000 immigrants who have lived in fear of deportation. It also bypasses Congress and partially achieves the goals of the so-called DREAM Act, a long-sought but never enacted plan to establish a path toward citizenship for young people who came to the United States illegally but who have attended college or served in the military.
Homeland Security Secretary Janet Napolitano announced the new policy Friday, one week before President Obama plans to address the National Association of Latino Elected and Appointed Officials' annual conference in Orlando, Fla. Republican presidential challenger Mitt Romney is scheduled to speak to the group on Thursday.
"Our nation's immigration laws must be enforced in a firm and sensible manner," Napolitano said in a statement. "But they are not designed to be blindly enforced without consideration given to the individual circumstances of each case.
Nor are they designed to remove productive young people to countries where they may not have lived or even speak the language. Discretion, which is used in so many other areas, is especially justified here."
Mr. Obama planned to discuss the new policy Friday afternoon from the White House Rose Garden.
Under the administration plan, illegal immigrants will be immune from deportation if they were brought to the United States before they turned 16 and are younger than 30, have been in the country for at least five continuous years, have no criminal history, graduated from a U.S. high school or earned a GED, or served in the military. They also can apply for a work permit that will be good for two years with no limits on how many times it can be renewed.
The policy will not lead toward citizenship but will remove the threat of deportation and grant the ability to work legally, leaving eligible immigrants able to remain in the United States for extended periods. It tracks closely to a proposal offered by Republican Sen. Marco Rubio of Florida as an alternative to the DREAM Act.
"Many of these young people have already contributed to our country in significant ways," Napolitano wrote in a memorandum describing the administration's action. "Prosecutorial discretion, which is used in so many other areas, is especially justified here."
The extraordinary move comes in an election year in which the Hispanic vote could be critical in swing states like Colorado, Nevada and Florida. While Mr. Obama enjoys support from a majority of Hispanic voters, Latino enthusiasm for the president has been tempered by the slow economic recovery, his inability to win congressional support for a broad overhaul of immigration laws and by his administration's aggressive deportation policy. Activists opposing his deportation policies last week mounted a hunger strike at an Obama campaign office in Denver, and other protests were planned for this weekend.
The change is likely to cause an outcry from congressional Republicans, who are sure to perceive Mr. Obama's actions as an end run around them. Republicans already have complained that previous administration uses of prosecutorial discretion in deportations amount to back-door amnesty.
Romney and many Republican lawmakers want tighter border security measures before considering changes in immigration law. Romney opposes offering legal status to illegal immigrants who attend college but has said he would do so for those who serve in the armed forces.
An NBC News/Wall Street Journal poll last month found Mr. Obama leading Romney among Hispanic voters 61 percent to 27 percent. But his administration's deportation policies have come under fire, and Latino leaders have raised the subject in private meetings with the president. In 2011, Immigration and Customs Enforcement deported a record 396,906 people and is expected to deport about 400,000 this year.
A December poll by the Pew Hispanic Center showed that 59 percent of Latinos disapproved of the president's handling of deportations.
The changes come a year after the administration announced plans to focus on deporting serious criminals, immigrants who pose threats to public safety and national security, and serious immigration law violators.
A senior administration official said the latest policy change is just another step in the administration's evolving approach to immigration.
Under the plan, immigrants whose deportation cases are pending in immigration court will have to prove their eligibility for a reprieve to ICE, which will begin dealing with such cases in 60 days. Any immigrant who already has a deportation order and those who never have been encountered by immigration authorities will deal with the U.S. Citizenship and Immigration Services.
The exact details of how the program will work, including how much immigrants will have to pay to apply and what proof they will need, still are being worked out.
n making it harder to deport, the Obama administration is in essence employing the same eligibility requirements spelled out in the proposed DREAM Act.
Two senior administration officials, speaking on the condition of anonymity, stopped short of calling the change an administrative DREAM Act — the name is an acronym for Development, Relief and Education for Alien Minors — but the qualifications meet those laid out in a 2010 version that failed in the Senate after passing in the House.
They said the DREAM Act, in some form, and comprehensive overhaul of the immigration system remained an administration priority.
Illegal immigrant children won't be eligible to apply for the deportation waiver until they turn 16, but the officials said younger children won't be deported either.

Last year, Napolitano announced plans to review about 300,000 pending deportation cases and indefinitely suspend those that didn't meet department priorities. So far, Immigration and Customs Enforcement has reviewed more than 232,000 cases and decided to stop working on about 20,000.
 
About 4,000 of those 20,000 have opted to keep fighting in court to stay in the United States legally. For the people who opted to close their cases, work permits are not guaranteed.

UDUGU WA KIISLAM MISRI WAELEKEA KUSHINDA UCHAGUZI


Chama cha Udugu wa Kiislam nchini Misri kimedai kuwa mgombea wake Mohammed Mursi anaongoza katika matokeo yaliokwisha hesabiwa kufuatiwa uchaguzi uliomalizika hivi karibuni.
Matokeo hayo ambayo yamebandikwa katika mtandao wa chama hicho, yanaonyesha kuwa Waziri Mkuu wa zamani wa Hosni Mubarak Ahmed Shafique anashika nafasi ya pili lakini msemaji wake hakuweza kuthibitisha madai hayo. Matokeo rasmi yanatarajiwa kuanzia siku ya Jumapili. Kama mambo yataendelea kama yalivyo, wawili hao watapambana katika duru ya pili itakayofanyika tarehe 16 na 17 mwezi ujao.
Chama cha udugu wa Kiislam kilisema Mursi alikuwa ameshakusanya theluthi moja ya kura, akifuatiwa na Shafique aliyepata asilimia 22. Msoshalisti Hamdeen Sabbahi yuko katika nafasi ya tatu akiwa na asilimia 20 akifuatiwa na Abdul Moneim Abul Futouh mwenye asilimia 17 kwa mujibu wa matokeo hayo ya awali yaliotolewa na chama hicho cha Kiislam.

Mursi mwenye umri wa miaka 60 na mwenye taaluma ya uhandisi aliingia katika kinyanganyiro hicho wiki tano zilizopita huku wapinzani wake wakimkejeli kwa kumuita tairi la akiba baada ya mgombea wa chama hicho wa awali kuondolewa na tume ya uchaguzi.

Katika kampeni zake, Mursi alikuwa akiahidi kuweka utawala wa sheria nchini Misri na amekuwa akiweka wazi kuwa anataka kutizama upya mkataba wa amani kati ya Misri na Israel, akisema kuwa nchi hiyo jirani na Misri haija heshimu Mkataba huo. Lakini chama hiki kimesema hakitauvunja Mkataba huo.
Mursi pia aliahidi kupambana na rushwa iliyokithiri kutoka enzi za Mubarak na kupunguza ukubwa wa serikali. Katika kampeni zake, Mursi alitembea Misri nzima akitangaza ilani ya chama chake iliyotengezwa kwa misingi ya Uislam. Mafanikio yake yamewafadhaisha wasiyo egemea dini na wakristu ambao wana wasiwasi na ahadi yake kuwa watakuwa na uhuru wao chini ya utawala wa chama hicho.

Mohammed alisema katika kampeni zake mateso waliyokuwa wakiyapata Wamisri chini ya utawala wa Hosni Mubarak ni kwa ajili ya sheria za Kiislam na kwamba damu yao na kuishi kwao kunategemea utekelezaji wa azma hiyo, na kuongeza kuwa kwa pamoja watapigana kutekeleza azma hiyo.

Nyota njema kwa Dk. Mursi ilianza siku ya Jumatatu baada ya matokeo ya Wamisri waishio nje kumchagua kwa asilimila 49 licha ya kura za maoni zilizokuwa zkiendeshwa na mashirika yanayoegeme upande wa serikali yakimuweka katika nafasi za chini kabisaa.
Mursi ambaye alipata Shahada yake ya uzamivu nchini Marekani na ambaye alitumikia sehemu ya maisha yake jela chini ya uatwala wa Hosni Mubarak, ni kiongozi muandamizi wa chama cha Udugu wa Kiislam ambacho pia kilishinda zaidi ya nusu ya viti vya Ubunge.

Mbunge wa jimbo la ubungo Mhe. John Mnyika (CHADEMA) leo ameibuka kidedea baada ya kushinda kesi ya kupinga matokeo ya uchaguzi katika jimbo lake iliyokuwa ikimkabili.

Akitoa hukumu ya kesi hiyo iliyofunguliwa na aliyekuwa mgombea wa Chama Cha Mapinduzi kwenye uchaguzi huo Bibi Hawa Ngh'umbi Jaji Upendo Msuya alieleza kuwa upande wa mashitaka (mlalamikaji) umeshindwa kuthibitisha madai ya ukiukaji sheria na taratibu zaujumlishaji kura zilizopelekea ushindi wa Mnyika kama ilivyodaiwa na upande wa mashitaka.

KI - MOON AHOFIA AL-QUEDA KUINGIA SYRIA.



Katibu Mkuu wa Umoja wa Mataifa Ban Ki-Moon amesema anaamini kundi la Al-qaeda lilihusika na mlipuko wa bomu mjini Damascus nchini Syria ambao ulisababisha watu kadhaa kupoteza maisha.
Ban Ki-Moon amesema pia kuwa rais Bashar Assad bado hajatekeleza mpango wa amani wa Koffi Annan uliokubaliwa na Umoja wa Mataifa na jumuiya ya nchi za Kiarabu.
Katibu Mkuu Ban Ki-Moon aliuambia Mkutano wa vijana uliofanyika katika Makao makuu ya Umoja wa Mataifa kuwa ushiriki wa Al-qaeda katika mgogoro wa Syria unasababisha matatizo makubwa zaidi na kwamba hali ilivyo sasa hivi haivumiliki hata kidogo.
"Siku chache zilizopita kulitokea shambulio kubwa. Naamini lazima Al-qaeda walihusika na shambulio hili na pia kulikuwa na mashambulizi mara mbili dhidi ya waangalizi wa Umoja wa Mataifa na kwa hivyo tunajitahidi kadiri ya uwezo wetu kulinda usalama wa raia," alisema Ban.

Syria nayo yaitupia lawama Al-qaeda
Syria imekuwa ikilishtumu kundi la Al-qaeda kwa kuhusika na mashambulizi makubwa katika wiki za hivi karibuni kama lile la Mei 10 lililosababisha vifo vya takribani watu 55 na kujeruhi wengine wapatao 400. Maafisa nchini Marekani na Urusi nao wanaamini Al-qaeda na makundi mengine ya wanamgambo wamejipenyeza ndani ya Syria.
Mwezi huu, Syria ilituma barua kwenda Umoja wa Mataifa ikiwa na majina ya watu 26 iliyowateka, wengi wao wakiwa raia wa Tunisia na Libya na kwa mujibu wa barua hiyo, 20 kati ya watu hao walikiri kuwa wanachama wa kundi la Al-qaeda.
Katibu Mkuu huyo pia alizungumzia mchango wa timu ya waangalizi wa Umoja wa Mataifa nchini humo ambayo ndiyo hatua ya kwanza kutekelezwa kati ya sita za Mpamgo wa amani wa Kofi Annan.

Kiongozi wa waangalizi ataka majadiliano
Wakati huo huo, kiongozi wa timu ya waagalizi, Meja Jenerali Robert Mood amesema hakuna idadi ya waangalizi itakayofanikisha amani ya kudumu nchini Syria bila ya kuwepo majadiliano. Akizungumza katika Mkutano na waandishi wa habari mjini Damascus, Mood ameziomba pande zote katika mgogoro huu kuacha kushambuliana na kutoa nafasi kwa timu yake kujenga mazingira ya majadiliano.
Wakati hayo yakiendelea, taarifa zinasema bomu lililopuka Ijumaa asubuhi katika mkoa wa Aleppo lilimuua mwanajeshi mmoja na kuwajeruhi wengine watano, kwa mujibu wa shirika la uangalizi wa haki za binadamu nchini Syria.
